Art. 1 [Anwendungsbereich] (1) Dieses Übereinkommen ist auf Kaufverträge über Waren zwischen Parteien anzuwenden, die ihre Niederlassung in verschiedenen Staaten haben, (a) wenn diese Staaten Vertragsstaaten sind oder (b) wenn die Regeln des internationalen Privatrechts zur Anwendung des Rechts eines Vertragsstaats führen. (2) Die Tatsache, daß die Parteien ihre Niederlassung in verschiedenen Staaten haben, wird nicht berücksichtigt, wenn sie sich nicht aus dem Vertrag, aus früheren Geschäftsbeziehungen oder aus Verhandlungen oder Auskünften ergibt, die vor oder bei Vertragsabschluß zwischen den Parteien geführt oder von ihnen erteilt worden sind. (3) Bei Anwendung dieses Übereinkommens wird weder berücksichtigt, welche Staatsangehörigkeit die Parteien haben, noch ob sie Kaufleute oder Nichtkaufleute sind oder ob der Vertrag handelsrechtlicher oder bürgerlich-rechtlicher Art ist.

Art. 1 (1) This Convention applies to contracts of sale of goods between parties whose places of business are in different States: (a) when the States are Contracting States; or (b) when the rules of private international law lead to the application of the law of a Contracting State. (2) The fact that the parties have their places of business in different States is to be disregarded whenever this fact does not appear either from the contract or from any dealings between, or from information disclosed by, the parties at any time before or at the conclusion of the contract. (3) Neither the nationality of the parties nor the civil or commercial character of the parties or of the contract is to be taken into consideration in determining the application of this Convention.

Art. 1 1) La présente Convention s’applique aux contrats de vente de marchandises entre des parties ayant leur établissement dans des Etats différents: a) lorsque ces Etats sont des Etats contractants; ou b) lorsque les règles du droit international privé mènent à l’application de la loi d’un Etat contractant. 2) Il n’est pas tenu compte du fait que les parties ont leur établissement dans des Etats différents lorsque ce fait ne ressort ni du contrat, ni de transactions antérieures entre les parties, ni de renseignements donnés par elles à un moment quelconque avant la conclusion ou lors de la conclusion du contrat. 3) Ni la nationalité des parties ni le caractère civil ou commercial des parties ou du contrat ne sont pris en considération pour l’application de la présente Convention.
